Judge tentatively rules against new Michael Jackson trial

A judge has issued a tentative ruling against granting a new trial in a negligence case filed by the mother of Michael Jackson claiming a concert promoter is financially liable for the singer’s death.

Los Angeles Superior Court Judge Yvette Palazuelos issued the lengthy ruling Friday but did not immediately finalize it after hearing more than two hours of arguments from lawyers.

A jury in October rejected Katherine Jackson’s lawsuit claiming AEG Live LLC negligently hired the doctor convicted of giving her son an overdose of anesthetic in 2009.

Her lawyers argued the verdict form didn’t allow jurors to fully consider evidence in the case.

AEG’s lawyers contend there was no basis for a new trial.

Nearly four years ago, audiences got their last look at Michael Jackson in the top-grossing concert film of all time, This Is It. Tens of millions worldwide saw a seemingly healthy and confident performer sing and glide across a rehearsal stage as he prepared for his ill-fated comeback tour.

Now, those same sessions are being replayed for a new audience: jurors in a case filed by Jackson’s mother, Katherine Jackson, claiming concert promoter AEG Live should be held liable for his untimely death in June 2009.

Through testimony and evidence, the panel has seen a very different picture of Jackson — one framed by descriptions such as “skeletal,” “lost,” absent from rehearsals and unable to perform songs that made him a superstar.

In a darkened courtroom, and in stark contrast, the jurors have also seen clips of the concert film — visibly captivated by Jackson’s smooth moves and easy vocals as he prepared for his This Is It tour in yet another indicator of the enduring allure of the so-called “King of Pop.”

AEG Live’s lawyers have used the film to point to the flashes of brilliance in Jackson’s final rehearsals as proof that its executives could not have known the singer would soon die.

But Katherine Jackson’s attorneys have played the footage juxtaposed to video of her son spinning and Moonwalking in younger years in an attempt to show that his skills were diminished and the film was selectively edited.

Michael Jackson's mom testifies in wrongful-death suit

Michael Jackson’s mother tearfully described finding out about her son’s death Friday and said she expressed concerns about his comeback concert schedule to the promoters of the tour.

Katherine Jackson said she called the CEO of promoter AEG Live LLC to express her view that her son could have done 50 shows, but not if they were spaced closely together.

“He couldn’t do every other night like AEG wanted him to do at first,” Katherine Jackson said.

She said she called AEG Live CEO Randy Phillips and her son’s manager, Tohme Tohme, to express her concerns about the This Is It schedule.

She didn’t describe any additional details about the calls. Katherine Jackson is expected to be the final plaintiff’s witness in her case against AEG Live, which has lasted 12 weeks. The defense case is scheduled to begin next week.

Katherine Jackson back home after judge removed her as guardian of Michael's children

Katherine Jackson is apparently back home, reuniting with Michael Jackson’s children after a judge temporarily took away her guardianship because of her days-long absence from them.

Paris Jackson tweeted early Thursday morning: “grandma’s here! (hash)thankyougod.” Katherine Jackson’s son Marlon also posted a note on Twitter saying his mother had returned, adding she looked and sound great.

On Wednesday, judge removed her as guardian temporarily and named her grandson Tito Joe “TJ” Jackson as temporary caretaker of the late legend’s three minor children amid a bitter family dispute over Michael Jackson’s estate. READ FULL STORY
