Cleveland prosecutors have elected not to charge Lost star Matthew Fox after an assault complaint was filed against him last month, reports the Associated Press.
Heather Bormann, a “Party Bus” driver from Cleveland, claimed that on Aug. 28 at 1:30 a.m., Fox attempted to board her bus, which was parked outside of a restaurant called Shooters. Bormann says that Fox demanded she drive him back to the Ritz-Carlton Hotel, but because she was hired to a private group, she informed him that he would need to find another ride. She alleged that Fox “attacked [her] with his fists, delivering sudden and severe blows to her right breast, groin, arm and legs, and inflicting severe, disabling injury and pain.” Bormann also suggested that Fox was heavily intoxicated at the time.
Cleveland city spokeswoman Andrea Taylor said in a statement today that the decision to not charge Fox was made “after a thorough review of the facts.” Bormann’s lawyer told the AP that the decision not to pursue criminal charges is a “miscarriage of justice.” Fox’s camp has not provided EW with a comment at this time.
Bormann, meanwhile, has filed a civil suit against Fox, alleging assault, battery, and intentional infliction of emotional distress, and seeking at least $75,000 in compensatory and punitive damages, as well as all litigation and attorney fees.
As phony as I think this claim is, I’m not surprised she didn’t ask for more. They will pay her off as a nuissance until the amount is to high. This is stupid, but he got some publicity.

SHE got the publicity… she made sure she was on every TV station in Cleveland, even before the police began investigating a day after. Even if Fox did commit a crime, you wait for the police before you hit the circuit.
You just have to ask for at least 75K for statutory reasons (the amount in controversy required)–I’m sure she’ll end up asking for more.
p.s. If she had, had any proof, she would have asked for a LOT more.

Really – If she had been “severely” injured – and if she were punched like she says… wouldn’t there be bruises and wouldn’t the cops have taken photos of them. Therefore, criminal charges would have been filed. Something certainly sounds fishy to me too!!

Fake claim…if she’d been as “hurt” as she claimed she would have had bruises and the like when she went rushing to the media. Oh, and there would have been witnesses…I mean for gods sake, it was a bus with people on it and outside.

Stefani Talbott a dancer / stripper from Oregon was in the news everywhere for 3 days in february 2010. She said she and Fox had unprotected sex twice. Then lo and behold the story disappeared. I guess big bucks changed hands – remember the frenzy around the ending of Lost ? The show would have been tainted with a lingering scandal.This second story could be another attempt to make some money- still he’s been there- drunk, belligerent . In both cases he showed poor judgment, questionable behavior- and got away , loosing only some money. Jack Sheppard had his personal issues, demons – life is imitating art ? Matthew Fox should count his blessings and try to clean up his life.
