Lindsay Lohan's jewelry store surveillance tape: What does it mean for Lindsay?

Almost one month after the actress dominated headlines when the Los Angeles District Attorney’s Office filed grand felony theft charges against Lohan for allegedly stealing a $2,500 necklace from a Venice, Calif., boutique, the store, Kamofie and Company, has released its surveillance video footage from Jan. 22, the day the alleged theft took place. But likely more interesting than the video itself — which will reportedly stream on necklacevideo.com (snippets already aired Monday night on Entertainment Tonight and The Insider) — is the question of whether its release will have an impact on Lohan’s fate.

According to the site, rights to the images in the video can be obtained through the Associated Press, and financial terms licensing the exclusive video to ET and Insider have not been disclosed. (The AP is only issuing this statement about their involvement in the video: “Under an agreement with the copyright owner of the video, AP’s commercial images division worked out a deal allowing Entertainment Tonight to air the video exclusively at this time.”) But some legal experts are saying Lohan’s defense team can now argue that the sale of the footage proves the store had a financial incentive to accuse the actress of stealing from them.

Christopher Spencer of Spencer Company, the organization behind the necklacevideo.com website (they also do corporate communications for Kamofie and Company), denies that claim. According to Spencer, it was not money that motivated the store to release the footage but a desire to clear up speculation over what was actually in the footage itself. “[Kamofie and Company] reached out to us for help, because they were being basically inundated with thousands of requests to see the video,” Spencer tells EW. “They needed some advice. I went ahead and made the decision for them that I thought that it was a good idea [to release the tape].” Kamofie and Company’s official statement echoes Spencer’s explanation: “We were upset with the various mischaracterizations we were seeing and hearing about the video and its contents, and we felt the video should be allowed to speak for itself.”

But with Lohan’s next court date set for March 10, will the tape’s release intervene with her still-undecided case? (As of last month, Lohan’s lawyer told press that the actress will be seeking a plea bargain, but with jail time on the table as part of the plea, that could easily change.) Defense attorney and Buchanan Ingersoll & Rooney Managing Partner Stuart Slotnick says the tape’s release could help Lohan’s case. “It is such a positive development for Lindsay Lohan,” Slotnick says. “It is awful blow to the prosecution’s case. [It seems Kamofie and Company is] trying to get publicity for themselves and for money. If I was the defense attorney, I’d say this is all a PR stunt for the jewelry shop. Her claim that she forgot to return a small piece of jewelry is a really believable claim.” (Lindsay’s camp tells EW they are not commenting on the video.)

Spencer argues that because the tape would have been released during trial — that is, if the case even goes to trial — the video should not change the proceedings in any way. “We felt it would not have any effect on a criminal proceedings. Because it’s just a fact of what happened,” Spencer says.

As for claims that Kamofie was out for money and PR, Spencer says,  “I don’t really have a response to that, because it’s obviously incorrect. It continues to address something that we’ve already said is false. It’s untrue that there’s an initial motive to get PR. If that was true, we wouldn’t wait two months [to release the tape].”

Kamofie and Company are also sticking to their story. “With regard to the question of Lindsay Lohan’s guilt or innocence, we repeat that Kamofie and Company never gave permission to Ms. Lohan to remove the necklace from the store,” the store said via a statement. “The rest is up to the jury … The tape speaks for itself. Anyone who is interested in the case should watch the tape.” We guarantee they will find an audience.

      Is that why you told police that there were two other people driving your car when you were busted. Is that also why you said that you borrowed the pants you were wearing with cocaine in the pocket and then later it was learned they were your favorite pants and there were pictures of you wearing them all over the place. YEAH YOU NEVER LIE YOU LYING PIECE OF CRAP!!!

      In 2008, Lohan was sued by a college student who claimed the actress stole and wore her $12,000 mink coat.

      In 2009, British police investigated the disappearance of $400,000 worth of Dior jewels from a photo shoot Lohan did with a British magazine.

      In April 2010, Lohan was questioned by police in connection with a stolen $35,000 Rolex. ANYONE SEE A PATTERN DEVELOPING… What year did she steal the necklace???

      Oh Yeah, that would be in January of 2011. Anyone know the odds Vegas is giving of Lohan stealing something in 2012??? That is unless she is in jail!!!

      OH, AND HOW MANY THINGS HAS SHE STOLEN AND WASN’T CAUGHT.

    She is a klepto as this isn’t the first time this has happened. However, there are 2 possible avenues that could save her. (1) If the jewelry store was in the habit of “lending” her jewelry to promote their store and (2) If she walked out with it on by mistake. The second one probably won’t fly given her prior history with alleged kleptomaniac behavior but it may get the charge reduced. Also, there’s NO WAY that cheap looking necklace is worth what the store claims. I bet Lohan’s team will ask the court to have it appraised and it’ll be significantly less.

      Are you serious? First of all, Lindsay Lohan has been in the public eye consistently since she was a teenager. When you know your actions are followed by the media, the public, and endless paparazzi, and you put yourself in a situation that even remotely makes you look like a criminal, you have no one to blame but yourself. Also, in regards to your comment below (“If [you] did it, would [you] want it all over the news?”): Well, no, I would not, but I also would never steal a necklace, or “steal” a necklace, or do most of the completely asinine things that Lindsay Lohan does. Plus, even if I did, I know that it would not be on the news, since I am not a celebrity. The fact that Lindsay Lohan knows that EVERYTHING she does will be on the news makes me think she’s even more stupid than I already imagined. Sorry, but I can’t feel sympathy for someone who constantly sabotages her own life and never seems to learn her lesson.

      Oh and Audrea, for future reference: your sentence should read, “I understand she may have or not…” rather than “may of.” The way you have it doesn’t make any sense; then again, you also prove that you can’t spell or use punctuation, so maybe expecting correct grammar is a bit of a stretch.

        I knew this whole case was BS from day one! If you saw that insider special on Lindsay, you’d know that she owns a TON of jewelry, so it’s not at all outside the realm of possiblity for her to have taken the necklace by mistake(dosen’t that the salesgirl never tried to stop her form walking out the store with it, how did she NOT notice? it’s not like the necklace was covered up or anything) forget which store it came from, assumed it was a loan, therefore saw no reason to return it, seems like an honest mistake to me. I don’t feel bad for the owners though, as according to Forbes they’re business has actually gone up since the incident occurred, which contradict the owners claims about selling the tape to “recoup losses” LOL yeah right!

    I’m “Switzerland,” but, among others, it looks like an element of PR stunt to me, not to mention the profit made (?) from selling the tape or the rights to broadcasting, etc. Anyway, given relatively limited info, my take is that it might not be a smart move for the jewelry shop in question.

    The jewelry tale really sucks. It all sounds like they planned to set up Lindsay so they could claim insurance compensation to the very least. Take a troubled customer and you’ll have a likely suspect…On the other hand, I wonder how a jewelry or any other store manages to keep in the business by not caring what merchandise their clients take from its premises. Even my neighborhood’s local Chinese Bazaar shop attendants are more careful about the cheap trinkets they have on their displays.

    It does seem like they took advantage of an easy target. I’m not a fan of Lohan, but if they weren’t doing this as a PR thing then why even have a cost for people to watch the video, why not just release it to prove her guilty?
