Image Credit: Mark Ralston/AFP/Getty ImagesThis morning, Lindsay Lohan went before a Los Angeles judge, who rescheduled her grand theft hearing for March 10, so Lohan’s lawyer, Shawn Chapman Holley, could examine discovery and a settlement from the District Attorney. Judge Keith L. Schwartz told Lohan during Wednesday’s hearing, which was broadcast live: “You will be treated exactly the same as everyone else. No better, no worse.” Schwartz was, however, clear about how the case could play out if Lohan pleads guilty or no contest, therefore admitting that she violated parole: “This case does involve jail time, period,” he said. “If you plead in front of me, if it’s resolved in front of me, you are going to jail, period.” The amount of time the actress could spend in jail under the plea is not known.
Schwartz also insisted on obtaining information on Lohan’s psychological background, and told the actress that he wanted her to find a sponsor who was not related to a family member. “I want you to get on with your life,” he said. Lohan was accused of stealing a $2,500 necklace from a Venice, Calif., jewelry store. It’s been reported that Lohan’s lawyer is seeking a plea bargain.

I’m not very well verse with law and stuff but if they’re insistent on her innocence why have a plea deal? If you’re not guilty don’t you just fight for that outcome?
Because sometimes even if you’re not guilty there’s evidence that raises doubts about your guilt/innocence. A lot of times its safer just to take a plea bargain than risk a trial. Especially jury trials – juries can be very unpredictable. And prosecutors like plea bargains because they don’t cost as much and they’re a guaranteed “win”.
Exactly. Just because you take a plea bargain doesn’t mean you’re admitting to guilt. You would just rather spend a limited time in jail than he possibility of a full sentence.

According to another site the offer was 6 months in jail if she pleads guilty or no contest….it also stated that if the judge decides on March 10th that this will go to trial, she will automatically still be arrested for the probation violation, either way she needs to suck it up, and do the time….she has had more chances than anyone who wasn’t a celebrity would have been afforded….this is jmo…

This is simply not true, it happens all the time. In the real world sometimes you have to do the smart thing. If you get a good plea bargain you shoulod take it. The alternative is often much worse.

Many times bad things happen to good people; for instance, a la he-said-she-said in, say, sexually related cases, etc. But, yes, if you’re seeking a plea bargain, people tend automatically to look at you as a culprit.

I thought that shoplifting is a treatable compulsive disorder. Unless the prosecutor and judge are psychiatrists, they must know something I do not. One wonders what APA and NAMI are thinking.
My sources indicate that Lindsay will ask if she can do volunteer work for underprivileged children…maybe do some reading to them in public libraries. Surely this should help all parties involved asnd help kids get back to reading. And this will help Lindsay focus and stay away from jewelry stores too. So it all works out for everybody, see?

What can be proven is often not the same as what actually happened. “Beyond a reasonable doubt” does not mean “beyond ALL doubt.” There are lots of reasons why a plea deal is the prudent choice.

Um, didn’t the judges already try jail? Never admit to anything–the judges will just use that as an excuse to throw you in a dungeon and forget about you. Our laws are still very medieval. Never trust judges. Judges are the real crooks in this country–they let their buddies on Wall Street steal billions of dollars. As for six months in jail–I’ve taken naps longer than six months.
As I see it she’s either going to get the help she needs while in the pokey or she’s going to eventually wind up dead somewhere with a needle sticking out of her arm. God knows that I’ve never been a Lohan fan but that’s the last thing that I’d want to see happen to the girl.
