50 Cent sued for copyright infringement: Accused of stealing gangster book's theme for his 2009 album

Filed under: Music, News and tagged:

Shadrach Winstead filed a lawsuit — obtained by EW — on Nov. 5 against Curtis “50 Cent” Jackson, accusing the rapper of copyright infringement and unfair competition. Winstead says 50 stole the plot and theme of his 2008 book,  The Preachers Son — But the Streets Turned Me Into a Gangster for his 2009 album Before I Self Destruct and its companion movie, directed by and starring 50. The case filings site several instances where portions of Winstead’s book had seemingly been lifted. For example, Winstead compared one line in his book: “My father and my mother were arguing a lot and sometimes she would leave and come stay with her mother and there would be just me, my father and my brother,” to 50′s movie dialogue: “It was just me, my mother and my brother.  My father went looking for a job and never came back.  Now it’s just me, my mother and my brother.”

There other alleged similarities between the the music and the book as well. Winstead’s book reads, “I used to go in the basement and stashed the coke. I had an uncle who used to go in the basement. He found my stash. He started smoking my s— up.”  50′s “Then Day Went By” features the lines, “My uncle smoked my stash up. I had 200 grams left under the porch. How much you going to smoke, man? How much you going to smoke, man?” Winstead is asking that sales of 50′s album be suspended and that he pay forward all the profits earned from the infringement.

'Daily Beast'-'Newsweek' merger is a go

Daily Beast editor and founder Tina Brown announced that her two-year-old website has merged with the 77-year-old news magazine Newsweek. The deal has been rumored for the past several weeks, and Brown confirmed with a note posted on Daily Beast Thursday, saying the deal “finally took place with a coffee-mug toast between all parties Tuesday evening.”

“What does this exciting new media marriage mean? It means that The Daily Beast’s animal high spirits will now be teamed with a legendary, weekly print magazine in a joint venture, named The Newsweek Daily Beast Company, owned equally by Barry Diller’s IAC and Sidney Harman, owner (and savior) of Newsweek. As for me, I shall now be in the editor-in-chief’s chair at both The Daily Beast and Newsweek…. Today, we look at print from the refreshed point of view of an expatriate who sees the old country with new eyes. That will create a great new creative energy — just as on the business side, it offers a superb dual marketing platform.”

Harmon said in a statement: “In an admittedly challenging time, this merger provides the ideal combination of established journalism authority and bright, bristling website savvy.”

'Garfield' creator apologizes for ill-timed strip

Jim Davis, the cartoonist behind Garfield, apologized on Thursday for a comic strip that stirred up controversy when it published on Veteran’s Day. In the strip, Garfield stands above a spider with a rolled up newspaper cocked in-hand. The spider taunts the cat, saying if he squishes him, “they will hold an annual day of remembrance in my honor.” In the final frame, a spider dangling over a teacher’s desk asks a class, “Does anyone here know why we celebrate ‘National Stupid Day?’” Davis said the strip was created almost a year ago and that running that particular comic on Veteran’s Day was the “worst timing ever.”

“The strip that runs in today’s paper seems to be making a statement about Veterans Day. It absolutely, positively has nothing to do with this important day of remembrance,” he said in a letter Thursday, addressed to friends, fans, and veterans. “I had no idea when writing it that it would appear today — of all days,” he said. “I do not use a calendar that lists holidays and other notable days, so when this strip was put in the queue, I had no idea it would run on Veterans Day.”
