Assistant Chief Coroner Ed Winter told AP that both deaths were likely preventable. “In simple English,” he said, “they didn’t take care of themselves.”

Gawker settles 'McSteamy' lawsuit

Categories: Lawsuits

Gawker Media has agreed to pay actors Eric Dane and wife Rebecca Gayheart an undisclosed sum and to remove the video they shot with friend Kari Ann Peniche in exchange for the couple dropping their $1 million lawsuit, The Hollywood Reporter says. The couple had sued for copyright infringement after the video leaked to Gawker’s Defamer blog and Fleshbot. Gawker argued “fair use,” and a U.S. District Judge ruled in December that the spouses could not recover statutory damages of up to $150,000 per infringement because they registered the tape with the Copyright Office days after it was posted online. The settlement was reached through private mediation. “Although we are confident that our use of the video on Gawker was protected fair use, because the posts already had been available to our readers for nearly a year, and because we already had won an important decision from the court striking large parts of the plaintiffs’ damages claims, we agreed to remove the posts as part of a global settlement to avoid the burden of further litigation,” Gawker COO Gaby Darbyshire said in a statement. Reps for Dane and Gayheart could not immediately be reached for comment.

Martin Bashir is decamping from ABC News’ Nightline for a spot with NBC News, where he’ll helm an afternoon show on MSNBC and contribute to Dateline, according to the Washington Post. Bashir has been anchoring Nightline since October 2005 and is most famous for his pre-Nightline chat with Michael Jackson in 2003, which was a sensational, ratings-grabbing special with the King of Pop. “I am absolutely delighted to be joining MSNBC and NBC,” Bashir said in a statement about the move. “This is a rare and special opportunity—to host a daily news and current affairs show and also work on long-form journalism both at MSNBC and with Dateline. This is an enormous privilege and I cannot wait to get started.” Bill Weir, a ABC News vet since 2004 who has worked as a reporter and co-anchor of weekend Good Morning America, will replace Bashir on Nightline.

Neil Gaiman owed royalties in 'Spawn' suit

Neil Gaiman is owed royalties from characters in Todd McFarlane’s Spawn comic-book series, according to a ruling by a federal judge in Wisconsin, reports Variety. The judge ruled that characters Dark Ages Spawn, Domina, and Tiffany were created by Gaiman when he worked on an issue of the Spawn comic in 1992, at the request of McFarlane. The dispute between Gaiman and McFarlane has been brewing for years, since a 2002 jury originally found that Gaiman had a copyright interest in three characters he’d worked on for the property.

'Sunny' songwriter, Bobby Hebb, dies at age 72

Categories: Music

Singer and songwriter Bobby Hebb, 72, who was best known for his 1966 hit song, “Sunny,” died Tuesday of cancer in Nashville, Tenn., according to the AP. “Sunny,” a song that’s been frequently covered by dozens of artists (including Cher, Frank Sinatra, Jose Feliciano, Marvin Gaye, and Wilson Pickett), was written by Hebb shortly after his brother was fatally knifed outside a Nashville nightclub. Hebb also told reporters that the song was a response to the assassination of President John F. Kennedy, which occurred the day before Hebb’s brother was killed. The surprisingly optimistic song, about how a woman’s smile brightened the musician’s mood, was later recorded in 1966 and became a hit that summer. Hebb was born to blind parents in Nashville, where his brother and he grew up performing as a song-and-dance team. Hebb remained active in Nashville until his death, operating his own publishing company and record label, Hebb Cats. He is survived by a daughter and four sisters.

After announcing her engagement to Levi Johnston less than three weeks ago, much to the surprise of the American public and the imagined chagrin of her mother, Bristol Palin confirmed to People that two of them are no longer together. The couple has a 19-month-old son and decided last month to give their relationship a second chance, but Palin, daughter of former Alaska governor Sarah Palin, says that on the very same day they announced their engagement, Johnston admitted that he might be the father of yet another teenage girl’s child. “He’s just obsessed with the limelight and I got played,” says Palin.
