Eric Dane’s lawyer says a video of the Grey’s Anatomy star and his wife, actress Rebecca Gayheart, frolicking nude with another woman is “not a ’sex tape’” and warned that it should not be used for commercial purposes, People.com reports. A Monday statement from attorney Marty Singer says: “This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public. Although the participants are nude, the tape is not a ’sex tape.’ It is a private tape made for only my clients’ personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients’ rights and will be exposed to significant liability.” The third person in the video is reportedly Miss Teen USA 2002 Kari Anne Peniche, who lost the title after posing for Playboy.

Attention, all famous people and wannabe famous people: do not film your private escapades! You are just asking for trouble. Smarten up.
It’s disgusting that Rebecca Gayheart is still working as an actress and not sitting in a jail cell for running down a 9-year-old boy, because she didn’t have the patience to wait until he crossed the street. And she got a slap on the wrist for it. I wish her nothing but humiliation, embarrassment, and misery for the rest of her life.
Name it what it is – you taped it. SO its not for public viewing does not make it any less of a Taped event between consenting adults.
Any celebrity that has their junk filmed should expect it to get out. Unless you are doing the deleting get the lawyers ready. And who gets naked with a friend and their wife, but do nothing? Come on McSteamy.
First off Rebecca Gayheart didn not run the boy over on purpose, it was an accident, she was not drunk and was not speeding. Secondly she paid dearly for it. She lost her liscene for several years and did community service and probation for years. She nearly lost her entire career and had to start over from scratch. It was an accident, a tragic accident and she’s showed a lot of remorse for it over the years.

I’m not a “bitter dude” at all. But justice was not served in her case. She got her license suspended for 1 lousy year, paid about $2,000 in fines, and did community service. Poor baby. Now she’s living a life of red-carpet premieres and limousines.
And Matthew Broderick got off even easier than that for his vehicular manslaughter.

Wow Garry and Nick…you two must have never done anything wrong, made mistakes or had an accident. You are very unforgiving people. It is a sad and tragic accident. She did not run him down on purpose. She was not drinking and she was not on drugs. I feel for that little boy’s family but her going to jail does nothing to bring him back. Vehicular manslaughter without gross negligence does not give you jail-time whether you are a star or not. She did not escape worse punishment because she is famous. I’m glad you two are not on a jury of my “peers” and I hope that if you or your family ever have an accident like this your peers will be more forgiving than you.

Sorry, Garry, but you still come across as bitter. Sure, you think that Ms. Gayheart and Mr. Broderick may have gotten off easy, but don’t you think that they’ll carry around some guilt for the loss of a life? Celeb’s lives aren’t always about “red carpet premieres and limousines,” you know.
As for the tape in question – have we not learned anything from the Paris Hilton sex tape (other than the fact that if you’re filming yourself, your wife, and a female friend, you’d better be doing something)?
They are so spinning this to try make it seem okay. Let’s see all three of them naked…check. All of them were on drugs…check. You have a Hollywood Madam investigation going on, and Eric Dan with his wife are at her apartment…check. They might not have sex on the tape, but you just know they did more than play nudist colony. It’s also well know Gayheart is into drugs, and now her husband appears to be in on it. Something nasty is brewing.
