Daniel Bark, 23, of Toms River, NJ has been arrested and charged with second-degree murder for the hit-and-run collision that killed former American Idol auditioner Alexis Cohen on July 25, the New York Daily News reports. Police say Bark allegedly hit Cohen with his 2005 Mitsubishi Gallant before fleeing the scene. Bail was set at $35,000; Bark faces 10 to 15 years in prison if convicted.
Update: Authorities now say that Bark, the suspect in Cohen's hit-and-run death, was fleeing police when he struck and killed the aspiring singer, People magazine reports. Bark, who has a previous DUI on his record, collided with a parked car in Seaside Heights, N.J., around 3:49 a.m., county prosecutor Marlene Lynch Ford said today. The suspect then reportedly failed to stop when a police officer on a bicycle commanded, allegedly hitting Cohen with his vehicle as he was fleeing. As a result, prosecutors have also filed additional charges of aggravated manslaughter, death by auto and eluding police. Bark already has a 2004 conviction for driving under the influence.








Well atleast they caught the person. Hopefully justice will be served.

Although it may have been an accident, fleeing the scene SHOULD make the sentence tougher. A 25 year old life lost and the MAXIMUM penalty is 15 years? Let’s see, as it’s probably his first offense, he’ll get 6-10. Then with time off for jail time served while awaiting the trial and sentencing, and then time off for “good behavior” once in jail, he should be out in 3 years. Yippee. That’s some justice for her family.

He will most likely be out in three years being that it is his first offense. In Canada, the dude would have gotten a hell of a lot worse but we are not Canada. He will get his license suspended and will be forced to do community service after he gets out. It is too bad for Alexis. I read that she finally woke up and had a reality check. She was studying to be a Vet.
The Daily News report says he was charged with “second-degree *manslaughter*” and not murder as noted above. Second-degree manslaughter seems equivalent to involuntary manslaughter (which is a more common term, I think). The difference between murder and manslaughter being the intent to kill. So in this case it seems they are charging him with accidentally killing her. I’m not a lawyer but I assume the maximum sentence would be a lot less had he not fled the scene. I’m not defending the guy because leaving the scene is inexcusable but accidentally hitting and killing someone with your car seems like a tough one. Think about how many times you are distracted (even slightly and for a second) while driving. There may not be many times but if circumstances and luck are against you one of those moments could result in a horrible accident. Yet at the same time a life has been ended and some punishment must be enforced. Anyway, everyone drive safe tonight.
