The AP is reporting that former TMZ photographer Ricardo Mendoza filed a civil lawsuit today against Britney Spears, claiming assault and battery stemming from an incident in which the singer accidentally ran over his foot in Beverly Hills in October 2007. The accident happened two hours after Spears learned she had lost custody of her children. In the intervening time, Mendoza auctioned off his tire-stained sock. Spears’ lawyers declined to comment about the case when contacted by EW.

I don’t think it will matter. According to tort law he has to file with in one year of being aware of the alleged incident. It’s passed the statue of limitations.

If a paparazzi is stupid enough to get that close to a car with a celebrity just to get a picture that they end up running over his foot, I say he deserved it. It’s not the first foot thats been run over by a celeb and it won’t be the last. Give them their space or take what happens jerks.

I remember that at the time the police refused to charge her because the paps were behaving with reckless disregard for their own safety.
